There’s no federal answer to any of this, and understanding why saves you a lot of confusion later. The Wire Act, at 18 U.S.C. § 1084, is aimed at using a wire communication facility to send bets across state lines on sporting events and contests, and its subsection (c) says outright that nothing in it shields anyone from state law. The payments statute, 31 U.S.C. § 5363, stops anyone in the betting business from knowingly taking cards, cheques and similar instruments tied to unlawful internet gambling, so it governs the money moving, not the game being played. Neither one licenses anything. Congress never built a federal permission slip for an online slot, so the only body that can hand one out is a state.
That also clears up the confusion that trips more readers than anything else here. Online sports betting and online casino games are separate authorizations under separate laws. Dozens of states will happily take your wager on a football game, and none of those laws touch a slot reel. Illinois, New York, Ohio and North Carolina all run legal sportsbooks and license zero online slots between them.
Maine is gray because a law that hasn’t produced a live market hasn’t produced a single legal spin. New Hampshire is gray despite showing up on rival lists, because its gaming sits under the Lottery Commission’s charitable-gaming framework and includes no online casino authorization whatsoever. And Nevada is gray, which reads like a typo until you check it. Nevada licenses online poker and mobile sports betting while keeping slots, blackjack and roulette on the casino floor, where you have to walk in to play them.

Rhode Island is the newest and the tightest. S0948 was signed in June 2023, slots went live on March 5 2024, and Bally’s is the only operator you can play with. Rhode Island was the seventh state to launch, and the seventh is where the count still sits.
One pattern explains why the count stays this small. In every one of the seven, an online licence hangs off something physical. Atlantic City casinos in New Jersey, licensed casino properties in Pennsylvania, Detroit and tribal operators in Michigan, racetrack casinos in West Virginia and Delaware, Bally’s two properties in Rhode Island, the two tribal nations in Connecticut. Nobody has ever been handed an online slot licence in this country without a bricks-and-mortar partner behind it, and that dependence is why market structure varies so sharply between states that look identical on a map.
All seven set the floor at 21, with no exceptions and no tribal carve-out on the online side. Each of them also checks where you are rather than who you are. The app confirms you’re physically inside state borders at the moment of the wager, and a licensed operator will decline the spin from across the line.

States With a Law But No Live Market
An enacted law is not a legal spin, and Maine is the proof sitting right there in the grid. Maine’s LD 1164 gives the four Wabanaki Nations exclusive rights to run online casinos, rulemaking has been underway since 2025, and not one legal slot has spun in the state. So the count stays at seven, no matter how many trackers have already coloured Maine in.
The timing is contested, not merely slow. Churchill Downs, which owns Oxford Casino, has sued over the tribal-exclusivity provision, and that litigation makes any launch date a guess. The enactment and effective dates in circulation disagree with each other, so we’re not going to print one. Enacted, tribal-exclusive, not live, disputed timing. That much holds up.
Everywhere else, the base rate deserves more respect than it gets. Bills get filed most sessions in a familiar handful of states, and almost all of them die quietly in committee. When you read that a state is “about to legalise” online slots, you’re usually reading a press release about a bill that hasn’t had a hearing.
Massachusetts is the example to carry around. Online casino bill H.4431 was sent to study by an 11-0 committee vote in March 2026, which in practice ends a bill for the session, and the Massachusetts Gaming Commission has confirmed that online casino games are illegal in the Commonwealth. Unanimous, not close.
Illinois iGaming has been proposed repeatedly and bottled up in committee every time, while the state’s online sportsbooks operate under a separate 2019 authorization that has nothing to do with casino games. And South Dakota’s SJR 504 on the November 3 2026 ballot is a mobile sports betting measure, not a slots vote, so a yes there changes nothing about the grid above.
Why do slots stall in states where sports betting sailed through? Look back at how every online market so far has been built on top of existing land-based licensees. The people who own the floors are also the people whose cooperation a bill needs. A sports betting bill hands them a new product. An online casino bill asks them to compete with their own slot machines. The politics of those two bills aren’t remotely alike.
Legislative status ages faster than anything else here, so read this section against the August date at the foot of the page before you lean on it.
Offshore Casinos and What “Available” Actually Means
The biggest offshore casino blocks most of the states that regulate, which is the exact opposite of what the rest of this subject implies. Live in one of the seven green states and you’re frequently locked out of the offshore lobby and pointed back at your own licensed market.
So let’s be plain about what these sites are. An offshore casino takes or accepts players from a state. It is never legal, never licensed and never regulated in the United States. The blocked lists differ enormously brand to brand. Ignition’s terms of use, at section 2.3, name five states, being Delaware, Maryland, Nevada, New Jersey and New York. Slots.lv’s own accepted-players page names the same five plus the Canadian provinces of Quebec and Nova Scotia.
Bovada is the worked example, because its own documents disagree with each other. The Terms of Service PDF, updated January 3 2024, lists five excluded states at section 2.3. The live help centre page, checked on July 13 2026, runs to twenty restricted jurisdictions.

Cafe Casino’s terms name no excluded states at all. Super Slots and Wild Casino, which share a platform, both prohibit use from a restricted state “as set forth in paragraph 15,” and paragraph 15 doesn’t appear in either document, while the Super Slots rules put the burden squarely on the customer to work out whether the service is permitted where they live.
Enforcement is what actually moves these lists. Michigan’s Gaming Control Board issued 45 cease-and-desist orders to illegal offshore operators in April 2026, and a wave like that is how a state ends up added to a restricted-territories clause.
One more thing about what a foreign licence buys you. Bovada’s governing law is the Autonomous Island of Anjouan in the Union of Comoros, with no Curacao or Kahnawake seal anywhere on its primary pages. Ignition operates through Bamboo Media under the Anjouan Gaming Board, registration 11548. Slots.lv holds Curacao Gaming Authority licence OGL/2024/670/0711. Those are real registrations in real jurisdictions, and none of them is a dispute forum you can reach from Ohio.
The ages don’t line up either. The offshore terms that state an age at all set it at 18, and an 18-year-old playing from a state where the law says 21 isn’t made lawful by an operator’s terms.

Super Slots gets no link from us, and the reason is the whole point of this section. Its legality article claims the company is “legally licensed and fully regulated” and never names a regulator, a jurisdiction or a licence number. No minimum-age clause appears anywhere across its terms, its rules, its account-opening instructions or its FAQ. Its restricted-state list points to a paragraph that isn’t in the document. The advertised offer runs up to $6,000 and the terms behind it sit past a login, so before you have an account there’s no match or rollover figure to read at all. A casino that won’t tell you who licenses it or how old you have to be hasn’t met the bar, and that gap is more informative than any ranking we could give it.

Minimum Payback, Real Payback, and What RTP Promises
One number decides more about your night than every strategy article ever written on this subject, and most players have it backwards. Payback is what a machine returns per dollar wagered across millions of spins, not the chance of anything happening tonight. The house edge is simply the gap between the dollar you put through and what comes back out. A machine returning 96 cents on the dollar isn’t giving you a 96% chance of anything.
Now the part almost nobody knows exists. In licensed markets, that floor is written into law. Several states set a statutory minimum payback for a slot machine, so the worst a machine may legally return is a matter of regulation rather than trust.
Pennsylvania’s is the strictest of the ones we checked, and New Jersey sets its floor lower.
Under 58 Pa. Code § 461a.7(a), a slot machine may not be set to pay out less than its theoretical payout percentage, which may not be less than 85%, calculated using the lowest possible wager available for any single play, and may not equal or exceed 100% at the highest eligible wager. Under N.J.A.C. 13:69E-1.28A(a), every slot machine game requiring a wager must have a theoretical return to player of at least 83 percent.
Put that in money instead of percentages. An 85% floor means the worst legally permitted machine in Pennsylvania returns 85 cents per wagered dollar over the long run, so about 15 cents of every dollar cycled is expected cost. New Jersey’s 83% floor allows 17 cents. A floor is the worst a licensed machine may pay, not what it does pay, so real machines generally sit above it.
New Jersey’s rules go further than a single figure, and they answer the question people actually have about penny machines versus high-denomination ones. Under the same section, a game’s theoretical return may not drop by more than one hundredth of a percentage point as the wager increases, with the aggregate of those decreases capped at half a percent across all plays the game offers. A licensed New Jersey slot can’t quietly get worse as you bet more, and the regulation caps how far it could drift by design. The same rules bar odds greater than 100 million to one, allow a progressive’s projected contribution to count toward the minimum return, and require skill-influenced games like video poker to have their return calculated at optimal strategy with that strategy disclosed. Where a game depends on the player’s knowledge or dexterity, the payout percentage is calculated on the least skilled player, not the best.
Whether you can check what your own state’s machines actually return is itself a state-by-state fact. Some gaming boards publish monthly win and handle figures, from which payback is arithmetic rather than marketing. Many release nothing at all, and several of the states that mandate a minimum are among those putting out no data on what their own machines really pay.
If you do go looking, one rule keeps you out of trouble. You need both the amount won by the house and the amount wagered to compute payback. A report giving win alone tells you what the casinos made and nothing whatsoever about the return, and the two get quoted interchangeably by people who should know better. Watch the labels too. Offshore, none of this applies. No US minimum binds those machines, no board collects the handle, and the brands disclose no payback themselves. Wild Casino’s lobby carries no provider names and no return figures at all. Bovada’s slots pages contain no house-edge figure anywhere. What you get instead is the operator describing itself, with Slots.lv saying its results come from a randomised algorithm producing an unplanned sequence of symbols and numbers. A company describing its own product isn’t a certification by anyone else, and no independent testing lab is named on its pages.
None of which leaves room for strategy, and pretending otherwise would do you a disservice. Nothing you do with the spin button changes the payback. Retail Slots: The Much Bigger Map
A gray pip means your state has licensed nobody to run an online slot. In most gray states you can still walk into a room holding several thousand machines. Fifty state paragraphs would tell you less than five venue classes do, because the class decides the machine, the regulator and the age.
Commercial casinos licensed by a state board are the familiar shape. Illinois runs 17 land-based properties under the Illinois Gaming Board. South Dakota’s Deadwood casinos sit under the Commission on Gaming, with betting limits lifted entirely in 2021. Louisiana spreads riverboat, land-based and tribal gaming under the Gaming Control Board and approves gaming parish by parish. Most states that allow commercial casinos pin them to defined zones, riverboats or a capped licence count, so the whole state never opens up.
Tribal floors under Class III compacts run true slot machines, and they’re the largest slice of American gaming by far. Oklahoma is the flagship, with more than 140 casinos across 30-plus tribes operating under the Model Tribal Gaming Compact and the 2004 State-Tribal Gaming Act, overseen at the state level by the Horse Racing Commission. Oklahoma licenses no online casino at all. Minnesota’s roughly 19 tribal casinos across 11 tribes, Wisconsin’s 11 tribes, Oregon’s ten casinos across eight tribes, North Carolina’s three, and Wyoming’s three on the Wind River Reservation all run on the same federal footing.
Class II floors are where the cabinet lies to you, politely. Alabama’s only casinos, the Poarch Band of Creek Indians’ Wind Creek properties, are limited to Class II electronic bingo because no Class III compact exists. Idaho’s tribal venues are similarly restricted to bingo-based machines and video-lottery-style terminals, and Texas’ three tribal venues centre on Class II gaming with Class III contested.
The difference is statutory and precise.
Class II gaming means bingo, whether or not electronic or computer aids are used, along with pull-tabs, lotto, punch boards, tip jars and instant bingo. The same subsection excludes banking card games and “electronic or electromechanical facsimiles of any game of chance or slot machines of any kind.” Class III, at § 2703(8), is everything that is not Class I or Class II, and it requires a tribal-state compact.
So a Class II machine isn’t a slot machine that happens to be regulated differently. It’s a bingo game wearing a slot cabinet, with the outcome drawn from a game shared among players, not an independent draw on your spin. Same seat, same reels, different game underneath.
Racinos put slot floors at racetracks under a lottery or racing commission. Delaware’s three racetrack casinos are the online market’s physical anchor, Nebraska’s five racetrack casinos run live tables alongside the machines, and several states run video lottery terminals through the lottery, with no casino board involved.
Route markets move the machines out of casinos entirely. Montana is the cleanest example, where the Gambling Control Division licenses video gambling machines in bars and taverns, capped by statute at a $2 maximum bet and an $800 maximum payout. That ceiling makes it a fundamentally different product from a casino floor, and it’s why Montana players describe the games as something you do at the bar rather than somewhere you go.
Charitable gaming is its own animal again. New Hampshire has no traditional commercial casinos at all, and every gaming venue partners with a registered non-profit that takes at least 35% of gross gaming revenue, under the Lottery Commission’s Charitable Gaming Division.
The true zeroes are two. Utah has no gaming regulator, and its constitution bars all gambling, with the state’s law drawing no distinction between skill and chance. Hawaii has no gaming commission and prohibits all commercial gambling by statute. No legal machine of any kind exists in either.
Compacts also explain the politics of the whole map. A tribal-state compact typically routes a negotiated share of gaming revenue to the state, and where that share is substantial the state already collects money from thousands of machines it never had to license individually. A state in that position has little appetite for authorizing online competitors to its own revenue source, and Oklahoma is the clearest case of exactly that arithmetic.

Why a Jackpot Stops at the State Line
Nothing crosses state lines for an online slot jackpot, so the same game can advertise wildly different top prizes in two states. No multi-state agreement covers online casino games, so a progressive pool is built from one state’s players, or one operator’s players inside that state, and stops there.
The proof that this is a licensing decision rather than a technical limit sits one game over. Delaware and Pennsylvania both belong to the Multi-State Internet Gaming Agreement, which lets their online poker rooms share player pools across state lines. The plumbing for interstate liquidity exists, regulators have already agreed to it, and it has simply never been extended to slots.
The consequence is arithmetic. New Jersey has roughly thirty licensed sites and Pennsylvania around two dozen platforms feeding their pools. Rhode Island has a single operator and Delaware a single vendor. An order-of-magnitude difference in the players funding the same title, and no game design can close that gap. The identical slot carries a far smaller top prize in a single-operator state, and that’s structural, not anything the operator chose.
How a progressive pays matters as much as how big it is. Some award the top prize only at maximum bet, and others award randomly regardless of stake, so an advertised jackpot may never have been available at the stake you were playing. Bovada’s own example shows the mechanic plainly, where a 2,000-coin payout becomes 10,000 coins at a five-coin maximum bet. Play a max-bet progressive below max bet and you’re funding a prize you can’t win.
Operators say very little about their own pools. Bovada names two of its progressive titles, A Night With Cleo and Food Fight, gives no jackpot count and discloses nothing about how the pools are built. We don’t print live jackpot totals either, since a figure that moves by the minute is stale before the page loads. How Old You Have to Be, and Where 18 Is Enough
Every one of the seven licensed online markets sets 21 with no exceptions, and yet in several states an 18-year-old can legally sit down at a slot machine. The age follows the venue rather than the state line, and that catches people out constantly.
Online, the answer never varies. Connecticut, Delaware, Michigan, New Jersey, Pennsylvania, Rhode Island and West Virginia all require 21 for real-money casino play, and no tribal or lottery exception softens it.
On commercial casino floors, 21 is effectively universal too. Nevada, Louisiana, Illinois, South Dakota, Massachusetts, Maryland, Colorado, Iowa, Ohio and the rest all set it there, and the reason is usually alcohol, not gambling. A floor licensed to serve drinks inherits the drinking age.
Tribal floors are where 18 lives. The tribe sets the age under its compact, and the working rule is whether alcohol is served on the gaming floor. Oklahoma is 18-plus at most tribal casinos and 21 where drinks are served. Washington follows the same split. Minnesota varies by tribe and property, with many venues at 18. Montana sets 18 for state-licensed video gaming and tribal gaming generally, with some tribal casinos choosing 21. Idaho’s tribal venues commonly sit at 18.
Several states carry both ages inside one border, and that split is the one to know before you drive somewhere. New York is 21 at commercial casinos and 18 at some tribal and Class II VLT facilities. California is 21 at most tribal casinos and card rooms with some venues at 18. Wisconsin is 21 at most tribal casinos and 18 at some. In each case the machines are a short drive apart and the answer is different.
These ages move, which proves they’re compact terms and not state constants. North Carolina’s tribal gaming age was raised from 18 to 21 by a 2001 compact amendment, so the same venue that admitted an 18-year-old one year turned them away the next without any change in state law.
Adjacent thresholds cause their own confusion. Idaho sets 18 for the lottery and pari-mutuel while its casino-style venues sit higher, and New Hampshire’s charitable gaming venues vary between 18 and 21 depending on the room, so checking the specific venue is genuinely necessary there.
Offshore, the terms that state an age at all say 18, and Bovada, Ignition and Cafe Casino all set it there. Slots.lv shows an 18-plus symbol without ever stating a number, and Super Slots states no minimum age anywhere on its primary pages. None of that changes what your own state’s law says about you. Age also gets checked when you try to leave with money rather than when you arrive, since identity verification sits at the first withdrawal, so an account can run for months before the question is ever asked.

Sweepstakes and Free Play, and Where They’re Being Shut Down
The sweepstakes route is real, it is not a licensed casino, and it’s being closed state by state faster than most sites bother to update. Anyone recommending these platforms without maintaining a live state list is handing you information with a short shelf life.
The model is simpler than the marketing makes it sound. You buy one virtual currency and are given a second one free, and only the second redeems for cash. That two-currency structure, plus a genuine free-entry route that has to exist for the promotion to work at all, is the entire legal argument holding the category up.
The enforcement is dated and specific. Oklahoma banned sweepstakes casinos outright under SB 1589, effective November 1 2026, with platforms required to exit the state by that date. Louisiana’s 2026 HB 53 advanced to fold gambling-by-computer and sweepstakes offences into the racketeering statute with considerably stiffer penalties. The Rhode Island Lottery has issued cease-and-desist orders to unlicensed sweepstakes sites. And Michigan’s board, in the same April 2026 action that hit offshore casinos, issued 45 cease-and-desist orders to unlicensed operators generally.
The part that matters most to you rarely gets written down anywhere. When a state closes the door, your access can disappear with no notice, and the platform is under no obligation to return a balance sitting in your account. There’s no state regulator to appeal to, because the whole premise is that the product is a promotion, not gambling.
In states with no legal casino of any kind, this is what fills the gap. Georgia has no casinos and no legal online casino, so sweepstakes and social platforms are the only slots-style play available in the state.
Free and demo play carries an assumption to check. Offshore .com lobbies let you spin most titles for nothing without an account, and a state-licensed app doesn’t necessarily work the same way, so expect the demo option to be thinner inside a regulated market. What a Slot Win Costs You at Tax Time
Two completely different taxes get mixed up constantly, so start by separating them. The enormous rates you read about on iGaming slot revenue are what the operator pays the state on its gaming win. Those never touch your return, and a state taking half of a casino’s slot revenue doesn’t change your tax bill by a cent.
The figure that does reach you moved recently, and it’s the most out-of-date one floating around this subject. The instructions for Forms W-2G and 5754, revised in January 2026, index the minimum reporting threshold to inflation for calendar years after 2025 and set it at $2,000 for payments made during 2026. For decades that trigger sat at $1,200 for a slot jackpot. Pages still quoting $1,200 are quoting a rule that changed.
The slot trigger is also its own creature. Under the same instructions, a W-2G is filed for slot machine winnings that meet or exceed the applicable reporting threshold, with no other test applied. Other wagering transactions, which is where table games fall, additionally require winnings of at least 300 times the wager. The same dollar amount can be reportable coming off a machine and not reportable coming off a table, and that difference catches people who assume a single rule covers the floor.
Reportable and reported aren’t the same thing either. An offshore win generates no W-2G because there’s no US operator to issue one, and the obligation to report the income is unaffected by the absence of paperwork.
Before a hand-pay ever stops your machine, know that regular gambling withholding at 24% doesn’t apply to slot, bingo or keno winnings at all. Backup withholding at the same 24% does apply if you can’t produce a correct taxpayer identification number, and it’s figured on the total winnings, not only the amount above the threshold. Separately, regular withholding at 24% kicks in on winnings minus the wager above $5,000 from lotteries, sweepstakes, wagering pools and sports wagering.
On losses, the current IRS position is narrower than people expect. Gambling losses are deductible only if you itemize on Schedule A, only up to the amount of gambling income you actually reported, and only if you kept a record of both wins and losses. Somebody taking the standard deduction gets no benefit from their losing sessions at all.
State income tax treatment varies on top of all this, and a handful of states levy no income tax whatsoever. We report the mechanics here and nothing more, because what you should do about any of it is a question for someone licensed to answer it.
Keeping Slots the Size You Meant Them to Be
The gap between what you wager and what comes back doesn’t close with time on the reels.
