Study order
A study order is not a delay and not a scheduling problem. In Massachusetts practice it is how a committee retires a bill without voting it down, and once a bill accompanies one it is done for the session.
Both chambers reached for the same tool on the same subject in the same month. If you are reading somewhere that Massachusetts iGaming is moving, under consideration or expected soon, you are reading something written before March 2026. The realistic next window is the 2027-28 session, and a revived bill starts from filing.
Massachusetts also differs from the average no-iGaming state in a way that changes what unregulated means on the ground. The Attorney General’s office runs a Gaming Enforcement Division, and it has sent cease-and-desist letters to offshore casino operators serving Massachusetts residents instead of treating the question as somebody else’s problem. Chapter 194 of the Acts of 2011, the Expanded Gaming Act, codified at M.G.L. c. 23K, created the Massachusetts Gaming Commission and authorized exactly three casino licenses in two flavors. The two Category 1 resort licenses came with terms built to keep small operators out. One license per region, an $85 million minimum license fee, a $500 million minimum capital investment that had to include a hotel, and a tax of 25 percent of gross gaming revenue. The single Category 2 slots facility license carried a different bargain, capped at 1,250 slot machines statewide with a $25 million license fee and a $125 million minimum capital investment, taxed at 40 percent of gross gaming revenue plus a 9 percent Race Horse Development Fund assessment. Add those together and you get the 49 percent figure in the Commission’s monthly revenue releases.

The statute divided the state into three regions and only two ever got a casino. Region C, covering Bristol, Plymouth, Barnstable, Nantucket and Dukes counties, has never had a license awarded. Southeastern Massachusetts, the South Coast, the Cape and the Islands are the hole in the map, and if you live there your nearest regulated floor is out of region and quite possibly out of state.

What H.4431 would have built is the shape any 2027 revival takes, and its terms were more specific than the coverage suggested. The bill set the privilege tax at 15 percent of a licensee’s adjusted gross internet gaming revenue, in lieu of all other taxes on those proceeds, well under half what the resorts pay on their floors. It let each internet gaming licensee issue up to three distinctly branded skins to platform providers, with no requirement that a skin carry the licensee’s own brand. Licenses would have run five years, with a $100,000 application fee for an operator license and renewals at $100,000 for operators, $50,000 for platform providers and $15,000 for suppliers.
The player-facing provisions were the part worth keeping. Accounts would have been restricted to people 21 or older with age and location verification built into the platform, total deposits by one person capped at $20,000 across any 24-hour period, and a self-exclusion list offering one year, three years, five years or lifetime, with an explicit rule that an excluded person collects no winnings and recovers no losses from play during the exclusion. The bill created a Player Health Program and a dedicated fund for it, required every operator to name a responsible gaming lead for the Commonwealth, and banned billboard advertising along with any marketing aimed at people under 21.
H.4431 Section 19, online sweepstakes game
Then there is Section 19. H.4431 defined an online sweepstakes game as a chance-based game reachable on a phone or computer that uses a dual-currency system of payment and simulates casino-style play, and made operating, conducting or promoting one in the Commonwealth unlawful.
It carried a fine of not less than $10,000 and not more than $100,000 per violation, plus potential loss of any gaming license, with repeat offenders exposed to increased fines and up to two years imprisonment. Assisting or supporting such an operation was covered too.
