Section 12-21-2712 tells any law enforcement officer to seize such a device and take it before a magistrate, who examines it and, on being satisfied it violates the section, directs that it be destroyed immediately. Alongside that, Title 16, Chapter 19 criminalises the playing and the keeping of gaming tables, and Article XVII, Section 7 of the state constitution reserves lotteries to the state alone, which is the clause the 2000 amendment had to open before the Education Lottery could sell a single ticket.
The four instruments behind the ban
S.C. Code § 12-21-2710, prohibited machines and devices. S.C. Code § 12-21-2712, seizure and destruction by magistrate order. S.C. Code Title 16, Chapter 19, unlawful games and betting, including § 16-19-40 and § 16-19-50. S.C. Constitution, Article XVII, § 7, which reserves lotteries to the State and, since the 2000 amendment, permits the Education Lottery.
The Video Poker Decade, And What Ended It

State, decided that October, the South Carolina Supreme Court struck the referendum down as an unlawful delegation of legislative power, held the ban severable, and let it stand. The vote never happened. The machines went anyway.
What the state switched off on July 1, 2000
Roughly 34,000 machines across about 7,000 locations, more venues than Nevada held at the time, in a state with a fraction of the population. Contemporary estimates put the industry near $3 billion a year. Act 125 of 1999 set the shutdown date; Joytime Distributors and Amusement Co. v. State struck the referendum that was meant to save it and left the ban standing.
Two consequences still shape this page. Enforcement in South Carolina runs criminal rather than regulatory, because there is no regulator to hand a matter to. And every gambling bill filed since has faced a chamber that watched an entire industry vanish on a court’s signature.
